Privacy Policy

Shoei Yakuhn Co., Ltd. (hereinafter “the Company”) is responsible for appropriately protecting the personal information of customers, suppliers or any other individual who provides his/her personal information to the Company (collectively hereinafter “the individual”) as a business entity that handles personal information as defined under the Act on the Protection of Personal Information (hereinafter “APPI”). The Company has, therefore, established the following Privacy Policy in order to appropriately manage personal information in its possession.

1.Obtaining personal information

The Company shall publicize (see “Purpose of use of personal information” below) and clarify in advance its purpose for using personal information (hereinafter “purpose of use”) prior to requesting an individual to provide his/her personal information. However, the Company may not state the purpose of use if the purpose of use after it obtains the personal information from the individual is obvious. In such case, the Company shall be restricted to using the said personal information within the obvious scope of use.

2.Management of personal information

1. In line with the APPI, the Company shall establish rules on managing personal information (hereinafter “Company Rules”) and shall establish positions for and appoint a Chief Privacy Officer and a Personal Information Manager to appropriately manage personal information.
2. The Company shall manage personal information in its possession in line with pertinent laws, policies, guidelines and Company Rules in order to prevent leaks, falsification, loss or unauthorized use thereof. Moreover, the Company shall impart education and awareness activities needed to appropriately handle and manage personal information to its employees.
3. In the event that the Company outsources the handling of personal information, the Company shall limit the outsourced information to the bare minimum required to effectively conduct business activities, and shall choose an outside handler that is approved to appropriately handle personal information. The Company shall require the outside handler to safeguard the personal information it is entrusted with, not to re-outsource its handling or management, prevent unauthorized use thereof and otherwise appropriately manage the said information.
4. The Company shall periodically and continuously review, assess and, where possible, improve its personal information protection system including this Privacy Policy and related rules.

3.Use of personal information

The Company shall not use personal information it has in its possession outside its stated purpose of use, except in the following cases.

1. With the consent of the individual
2. When disclosed in a manner (statistical data, etc.) from which the individual cannot be identified
3. When use outside the Company’s stated purpose of use is approved under the APPI or other pertinent laws, regulations, policies or guidelines

4.Changes to the purpose for using personal information

The Company may change its purpose for using personal information within a degree that would seem reasonable to the individual, but shall notify the individual of and publicize any such changes unless otherwise required by law.

5.Disclosure of personal information to third parties

The Company shall not disclose personal information it has in its possession to any third parties, except in the following cases.

1. With the consent of the individual
2. When disclosed in a manner (statistical data, etc.) from which the individual cannot be identified
3. If the Company is succeeded by another company as a result of complete or partial merger, split, spin-off or other corporate restructuring, and the personal information is disclosed to the successor
4. If disclosure is necessary to protect life, limb or property, and consent cannot be obtained from the individual
5. If disclosure is particularly necessary to improve public health or to promote the healthy development of a child, and consent cannot be obtained from the individual
6. If disclosure is necessary to cooperate with national or local authorities, or persons or entities entrusted with performing the duties thereof, and obtaining the consent from the individual could interfere with said duties
7. When otherwise required by law

6.Joint use of personal information

The Company may jointly use personal information with affiliates (see “Joint use of personal information” below).

7.Inquiries regarding personal information

An individual may view, edit or delete his/her own personal information possessed by the Company by contacting the below “Support” office and completing the procedure required by the Company. The Company shall comply with such requests as reasonably possible and required. To prevent unauthorized access, falsification or other malicious use of the personal information by third parties, the Company may verify that the request is coming from the individual him/herself as a part of that process. If the request cannot be verified as coming from the individual him/herself, the Company may deny the request. Calls to Support may be recorded and monitored to ensure proper responses are made by the Company.

8.Handling of opinions, requests, etc.

The Company may freely use the opinions, requests and suggestions it receives, unless the purpose of use thereof is otherwise restricted. However, the Company shall not publicize nor disclose to third parties said information in any state or manner that can identify the individual without the prior consent of the individual.

9.Compliance

The Company shall comply with the APPI and all other pertinent laws, regulations, and Company Rules.
